Terms of Use and Sale

1. Purpose

These Terms of Use and Sale ("Terms") govern access to and use of Promptia, a library of prompts for AI tools (image generation and language models), published by Moon Creative Works.

2. Acceptance

Accessing the site and creating an account constitutes full acceptance of these Terms.

3. User account

Creating an account requires a valid email address. You are responsible for keeping your credentials confidential and for any activity carried out from your account.

4. Service description

Promptia offers a catalog of prompts, some free, others sold individually or included in a Pro subscription (monthly quota). The technical body of each prompt is deliberately written in English, since AI models produce better results from English instructions.

5. Pricing and payment

Prices are shown in euros. Payment is processed by our provider Stripe; Promptia never stores card data. The Pro subscription renews automatically at each term unless cancelled beforehand from your account area.

6. Right of withdrawal

Under applicable EU consumer law, the right of withdrawal does not apply to digital content supplied on an intangible medium whose performance has begun after the consumer's prior express agreement and express waiver of that right. By purchasing a paid prompt or subscribing to Pro, you get immediate access to the content and acknowledge that you waive your right of withdrawal for that content.

7. User-submitted content

Any user may submit their own prompts for publication via the dedicated form. By submitting a prompt, you acknowledge and agree that:

• the content will be published free of charge on Promptia once approved by moderation, with no payment or revenue share;
• you represent that you are the author of the submitted content or otherwise hold the rights needed to publish it;
• Promptia reserves the right to refuse, edit, or remove any submitted content, notably if it is unlawful, infringing, or does not comply with these Terms.

A loyalty program may grant temporary Pro access to the most active contributors, under conditions set by Promptia and subject to change at any time.

8. Intellectual property

Site content (other than user content) remains the property of the publisher. Purchased or unlocked prompts grant you a personal or professional, non-exclusive, non-transferable right to use them to generate content via third-party AI tools; they may not be resold or redistributed as such.

9. Prohibited use

You may not use the site for unlawful purposes, attempt to automatically extract its content (scraping), circumvent security measures, or otherwise disrupt the service.

10. Termination

Promptia may suspend or close an account for violating these Terms, without notice in case of serious breach. You may delete your account at any time from your account area or by contacting contact@promptia.fr.

11. Liability

The service is provided "as is". Promptia does not guarantee the results produced by third-party AI tools used with the prompts offered and cannot be held liable for their use.

12. Governing law and mediation

13. Changes to these Terms

Promptia may amend these Terms at any time. The version in force is the one applicable on the date you use the site.
